By downloading, installing, or using the nutrk.app mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

nutrk.app is a fitness and nutrition tracking application that helps users log meals, track macronutrients, monitor workouts, and work toward personal health goals. The Service is provided for informational and personal wellness purposes only and does not constitute medical advice.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. Users between 13 and 18 must have parental or guardian consent.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate, current, and complete information during registration.
  • You are solely responsible for all activity that occurs under your account.
  • You must notify us immediately at support@nutrk.app if you suspect unauthorized access.
  • We reserve the right to terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Upload, transmit, or distribute malicious code, viruses, or harmful content.
  • Scrape, crawl, or harvest data from the Service without authorization.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the integrity or performance of the Service.

6. Health Disclaimer

The content provided through the Service — including nutrition data, calorie estimates, macro breakdowns, and workout suggestions — is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making significant changes to your diet or exercise routine.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of nutrk.app or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. User-Generated Content

By submitting content to the Service (such as custom foods, workout logs, or profile information), you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content solely for the purpose of operating and improving the Service. You retain ownership of your content.

9. Subscriptions & Payments

Certain features of the Service may require a paid subscription. Subscription fees are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a subscription period except where required by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, nutrk.app AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction of our principal place of business.

13. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
